black mold in my apt, complex will not comply?

Misha C asked:

I have black mold in my dishwasher and in air vents, I have complained several times and they won’t fix anything or clean anything. I won’t pay rent, and no one notified me of a court date and they are trying to evict me. My 8 month old daughter has never been sick a day in her life until we moved her now she has trouble breathing and has constant congestion as well as my fiancee and I. Who do I report them to? I’m moving out regardless of my lease I just don’t want an eviction on my credit bc of a nasty apt complex. And also just so you know, dishwasher doesn’t work and won’t drain the water that’s been sitting there since i moved in in July and my rent is 1100 and that includes nothing for a 2/1 with NO amenities. Come on now need I say more? I live in Ft. Lauderdale, FL by the way.

For starters, you need to use your head with this ‘mold’. Has it occurred to you to put bleach into the standing water in the dishwasher ? That will kill any mold which MAY be harbored there. As far as the mold in the vents, just HOW did you determine that there is mold in the vents ? Did you crawl inside of the vents and obtain samples of what is there, or did you just guess ?

Unless you manage to substantiate that you are leaving because of a mold problem (you will need test evidence for proof), you will be evicted AND it will be on your credit report. Your simple claims that you are leaving because of ‘mold’ won’t hold water in a court unless you have documented evidence that there was mold, and that it was harmful mold.

Have a city building inspector come to your complex free of charge and write up the violation(s) in your building. This is not your fault, nor is it your problem to get fixed. The building inspector will write a formal complaint to your landlord and he will have a certain amt of time to have it fixed. It is illegal for the landlord to make you pay for having black mold removed (which is a violation) and if it isn’t fixed, you can sue. Black mold is a health hazard and should not be attempted to be cleaned by anyone but a professional.

It sounds like the black algae that grows inside of drain pipes. A little bleach will take care of that.

The odds of you having dangerous mold in your dishwasher are literally ZERO. No chance. Nada.

The dangers variety grows in a humid, not wet environment, with no light and feeds on cellulose. There is no cellulose available inside of a dishwasher.

There is no way to prevent an eviction from appearing on your credit report. You are not paying rent, you need to be evicted. Other landlords need to know that you will illegally withhold rent and they deserve to see this on your credit report in order to protect themselves from you.
