We have a problem with mold in our house. We moved into a place last February. The landlord claimed there was electric heat thru floor board heaters. They skyrocketed the electric bill and produced no heat whatsoever. They just felt hot to the touch. He said he would take care of everything before next winter because there was a small amount of mold in our bedroom. It has very poor insulation and the only thing we run is kerosene so the walls sweat. It was getting warmer when we moved in so we had no major problems. Now that it’s getting colder, we’ve noticed small patches of mold on the walls. We cleaned it. It came back within 2 days. We were cleaning around the stove and pulled it out. Black mold (toxic or non toxic?) was everywhere. We started just pulling things out away from the walls. Mold is on all of our furniture. In our 2 year old daughter’s room. all around the rooms. All over 3 dressers, 2 nightstands, her comforter set, pillows, toys, her clothes. We pulled the crib out. There’s a little on her crib. There’s a lot on our bed. We can’t sleep in our bed. She can’t sleep in her crib. The real kicker is the woman who lived there before us now lives in front of us. She told us that the landlord knew that there was no heat in the house, which I found out is illegal in our state to rent a property with no heat. And he also has known about the mold. He let us move in anyway, with a baby. I wonder when we got that bit of mold in our bedroom if any more had grown behind the furniture then, in february, and how long have we been breathing this stuff in. When we told him it started again, at the first sign of it, he said he would put a furnace in the house so it would be dry. For 2 weeks we called everyday. He would not answer. Now many many things we owned are ruined. we took pictures. I want to know if we have a case. Not only because of our furniture, but having to freeze in that place with only a kerosene heater. And also putting our health at risk. by the way, since discoveringthe whole infestation, our daughter has been out of the house with her grandmother.

Many have renters rights. Some states have renters rights on the state web site. Do your research. If all else fails ask an attorney. It maybe the best 150 dollars you ever spent.

Black Mold can be deadly. You need to contact your local housing authority and explore your options. I would also visit a competent attorney if I were you.

At the very least go talk to the Department of Health and find out whom to contact. Do not wait, do not delay, do not allow this to be swept under the rug. If your landlord is doing this to you he is doing it to others. Especially if you have children or suffer from asthma or any other respiratory illness, you need to get out of there as soon as possible. Many states have laws directly addressing black mold issues.
It is not a trivial or minor issue.

You really have to move out. As soon as possible before you get sicker. It is worth any cost to get out, even if you have to take the loss on the moving expenses. The house is already too far gone to be saved. It needs to be gutted and fully rebuilt.
Just get out.

For the simple purpuse of not getting you wrongly advised. Imagine I say yes fro sure…. or no you cant there is a law of this and that….
You could just go hoping in something that is actually not true…
I say get a lawyer and ask him. Usually as long as they dont sit and see the entire file they wont charge you . Even if they do. Its still good to have a professional opignon.
